6. Carrier Liability

Streamsource Technologies is not liable for delays or failures in SMS delivery caused by a mobile carrier, network conditions, or device settings. T-Mobile and other wireless carriers are not liable for delayed or undelivered messages. You are responsible for charges imposed by your carrier.

7. User Responsibilities

You agree to provide accurate information, use the Site lawfully, avoid interfering with Site operation, and comply with these Terms.

8. Intellectual Property

Site content, including text, graphics, logos, images, and software, belongs to Streamsource Technoloiges, Inc. or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without prior written consent.

9. No Warranties / No Guarantees

The Site and its content are provided “AS IS” and “AS AVAILABLE” without warranties of any kind. We disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and completeness. We do not guarantee uninterrupted operation or any specific outcome.

Our total aggregate liability will not exceed the amount you paid us, if any, during the twelve months preceding the claim.

12. Arbitration and Class Action Waiver

Any dispute, claim, or controversy arising from these Terms or Site use will be resolved exclusively through binding individual arbitration administered by a recognized arbitration organization under its then-current rules in the State of New York.

CLASS ACTION WAIVER: You and Streamsource Technoloiges, Inc. waive the right to bring or participate in a class, collective, consolidated, or representative action. If this waiver is unenforceable, the entire arbitration provision will be void.

13. Governing Law

These Terms are governed by and construed exclusively under the laws of the State of New York, without regard to conflict-of-law principles.

14. Modifications

We may modify these Terms. Changes will be posted on this page with a revised “Last Updated” date. Continued Site use after a change constitutes acceptance of the updated Terms.
